These Terms and Conditions ("T&C") constitute a legally binding agreement ("Agreement") between you / end customer ("User") and House of Abhinandan Lodha Private Limited, including all its affiliate/group companies (hereinafter referred to as "HOABL", "We", "Us" or "Our" on the Platform) governing your access to and use of the HOABL application program interfaces, including any sub-domains thereof, and any other websites through which HOABL makes its services available (collectively "Platform"), our mobile, tablet and other smart device applications, and application program interfaces (collectively, "Application") and all associated services (collectively, "Services").
The Platform, Application and Services together are hereinafter collectively referred to as the "Platform/Portal".
Please read these T&C carefully before using the Platform. By accessing and / or using the Platform, the User becomes a registered user of the Platform constitutes a binding legal agreement between Users and HOABL and the User signifies his/her/its agreement to be bound by these T&C. HOABL reserves the right, at the sole discretion of HOABL, to change, modify, add or remove portions of these T&C, at any time without any prior written notice to User. It is the User's responsibility to review these T&C periodically for changes/ updates. The User's continued use of the Platform following the posting of changes/ updates will mean that the User accepts and agrees to the revisions. As long as Users comply with these T&C, HOABL grants Users a personal, non-exclusive, non-transferable, limited privilege to use and enter the Platform. Users agree that the User's use of the Platform shall be strictly governed by this T&C.
If you use the Platform, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer/device to prevent unauthorized access to your account. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorized manner. Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when registering. You can access and update much of the information you provided us with in the Your Account area of the website, Android Application and IOS Application. You agree and acknowledge that you will use your account on the Portal to only for your personal use and not for business purposes. Our Platform and Services may have different features and offerings in future. In lieu of the same, additional terms or requirements may apply to User's use of those features or offerings. If additional terms are available for the specific services for the User's use, those additional terms become part of these T&C. HOABL reserves the right to refuse access to the Portal, terminate account/s, remove or edit content at any time without notice to you.
The User shall be entitled to use the Platform upon completion of the registration process as provided on the Platform. The registration process involves creating of a login ID which shall be generated upon successful submission of an OTP sent to each User's registered mobile number, after providing basic information about themselves such as name, sex, email, age, address, telephone etc., and accordingly an account shall be created ("Account"). Only after completing the registration process, a person becomes a registered User with HOABL who shall be entitled to use the Platform. The Users understand and agree that HOABL may screen and verify the information provided by the User and at its sole discretion, increase the amount or number of information for the registration process and may ask for further information even after the registration process. HOABL may in its sole discretion close the Account of any User, if any information provided is found to be false or the information provided is not sufficient. The User shall ensure that the registration data provided by the User must be accurate, complete, current, and true. HOABL shall bear no liability for false, incomplete, old, or incorrect registration data provided by the User. The User hereby expressly consents to receiving communications from HOABL through the User's registered phone number and/or e-mail id. The User further consents to be contacted by HOABL's representatives via phone calls/SMS notifications. The User agrees that any communication received by the User from HOABL will not amount to spam, unsolicited communication or a violation by HOABL. The User shall be solely responsible for maintaining the confidentiality of his/her/their registration data and will be liable for all activities and transactions that occur through his/her/its Account, whether initiated by the User or any third party. The password and other details of the Account should not be shared with any third party. The User's Account is non-transferable and is not capable of being sold to a third party. HOABL shall not be liable for any loss that may incur to the User as a result of someone else using the User's password or Account, either with or without the User's knowledge. In the event of any change in the said information, the User agrees to promptly update his/her/their account information to ensure that the communications We intend to send to the User are promptly delivered and are not sent to any other entity/third party. HOABL reserves the right to suspend or terminate the User's account with immediate effect and for an indefinite period, if HOABL have a reason to believe that the registration data or any other data provided by the User is incorrect or false, or that the security of the User's account has been compromised in any way. We allow the User to open only one Account in association with registration data provided by the User. In case of any unauthorized use of the User's account please immediately reach Us at the Email: care@hoabl.in . In case, the User is unable to access his/her/its Account, please inform Us at Email: care@hoabl.in and make a written request for blocking the Account. We will not be liable for any unauthorized transactions made through the User's Account prior to the User making a request in writing for blocking and We shall require at least 72 (Seventy-Two) hours to process your request unless in case of force majeure events which are beyond Our reasonable control.
The Users agree to receive email/SMS/phone calls/letters from Us/ other registered Users (as the case may be) in order to use the Platform and avail Services provided by Us. The Users agree that Our Services under the Platform are non-transferrable. The Users further agrees that We may put further terms and conditions in relation to the use of Our Portal. The User hereby accepts the terms and conditions mentioned herein by providing the mobile number/ Email-id on the Platform to receive an OTP for login. The User agrees and permits Us to access files/photos/contacts and other media for the purpose of rendering Services to the User. The User consents and allows Us to acquire biometric data, facial recognition, pattern lock key and password for the purpose of security. We assume no responsibility for any damages to, or viruses that may infect User's equipment on account of User's access to or use of the Platform.
This KYC policy shall apply in case of any monetary transaction done with HOABL or any Platform/Portal/Application thereof. User hereby agrees to provide its KYC details including identity proof, bank account details, PAN number/Card, and residence proof in accordance with the law concerned. HOABL presumes that all the data given for KYC verification is true to the fullest knowledge of the User, and for which HOABL will not be liable to any extent if the validity of data is proved otherwise. HOABL reserves the right to terminate any Account or transaction thereof, with or without notice to the User, in the event the KYC documents / information is found to be incorrect.
Use of the Services, through Portal, or by any other means, is available to persons who can under Applicable Laws in India enter into a legally binding contract under Indian Contract Act, 1872. The User must be 18 years of age or older to register. In case of minor, the parent or guardian can do registration on his/her behalf. We reserve the right to refuse, restrict, suspend, limit or terminate any or all Platform Services provided to any User at any time for any reason.
The information and statistics presented in the Platform are of a general nature only and do not take into account the particular needs or individual circumstances of investors. HOABL does not give any warranty, whether express or implied, as to the accuracy, reliability or otherwise of the information. Decisions based on material displayed on Platform are the sole responsibility of the user.
HOABL by way of its Services and User's use of the Platform provides a nonexclusive, revocable, non-assignable license to use the Platform of HOABL. The rights granted under the Platform by Us to the User are personal in nature and character.
All payments made on the Platform by you shall be compulsorily in Indian Rupees acceptable in the Republic of India. You can pay by credit card or debit card or net banking, or any other RBI approved payment method. You understand that the payment facility provided by us is merely a facilitator providing an electronic, automated online electronic payment facility.
In case of cancellation, if any, the Applicant(s) is required to send an email to withdrawal@hoabl.in alongwith a copy of the cancelled cheque of the Applicant(s). The terms and conditions in respect of the cancellation shall be applicable as per Cancellations and Refund Policy in respect of the Project, service or product.
The User agrees to indemnify and keep indemnified and hold HOABL, its officers, subsidiaries, affiliates, successors, assigns, directors, agents, service providers, suppliers and employees, harmless from any claim or demand, including reasonable attorney fees and court costs, made by any User/third-party due to, or arising out of the User Content, registration data and any information submitted by the Users.
HOABL is the sole owner or lawful licensee of all the rights and interests of the Platform and the data therein. The Platform embodies HOABL's Intellectual Property Rights protected under worldwide copyright, trademark and other laws. All title, ownership and Intellectual Property Rights in the Platform and data shall remain with HOABL and its affiliates.
The User agrees that this T&C and any contractual obligation between HOABL and User will be governed by the laws of India. The courts at Mumbai shall have exclusive jurisdiction over any disputes arising out of or in relation to this T&C or the User's use of the Platform.
